Description of legal work: I think someone has infringed a trademark I have and I need advice on the validity and if required help on protecting my trademark. If the claim is valid, will need the relevant letters etc produced and so that they can be sent to the infringing party.
- The trademark in question is AromaTools https://oami.europa.eu/eSearch/#basic/1+1+1+1/50+50+50+50/aromatools. From this link you can see what I registered. Also need advice if I need to add a logo or in the current state is the trademark suitable?
- The other party using it is a US based retailer who has now set up an operation in Holland that ships out books that features my trademark. https://www.aromatools.com/AromaTools_International_s/707.htm I have done some research and it looks like they have an agreement with a dutch company that ships out their products rather than them actually setting up an entity in Holland.
To complicate matters slightly, I do buy stock from this company, but my aim is to continue buying stock from them in the short term, so my aim of taking action against them is to potentially negotiate some sort of settlement or make me the only company in Europe that can resale their products, i.e. replace the Dutch company.
I also need advice on using trademarks in some literature that I am producing. Want to know the correct way to mention products that are trademarked by another party. For example how would I mention say iPhone so that the trademark holder is properly referenced and I don't have to pay royalties etc.
