We have a preliminary hearing in the Employment Tribunal of Manchester on 13th June at 10am. ELH 1 hour. The Claimant is claiming unpaid holiday pay (historic) going back to an employment between 2008 and 2010. The hearing is to determine limitation and whether the Claimant was a worker.

Advice is not needed. Client has had advice from solicitors that he has 60% prospects of success of defeating limitation argument (due to suggestion by ECJ that UK law is incompatible with EU Law) but due to costs, has had to draft pleadings himself but needs representation.

There is one final complication in that the client is a former sex offender. Offence of sexual grooming of a child in 2007. Turned his life around since. The Respondent are using this fact against the Claimant. The Claimant has pleaded his criminal history in his claim and is relying on it. Conviction is spent.
