We are currently in dispute with a brickwork subcontractor who has undertaken substantially defective work to several projects including extensions and new-build homes. The defects have been identified and recorded independently by NHBC & Building Control. We are also in the process of appointing an independent expert witness as quickly as possible to act as expert witness if required. They have appointed a debt-recovery solicitor who is threatening to issue a Stautory Demand and are treating the outstanding monies as one claim, when we believe it should at least be three.
In a separate matter, we have a basement tanking company whose system has also failed and they are refusing to remedy the works. We have withheld the balance of payment, albeit that the remedial costs will far exceed the balance outstanding. Furthermore, the monies we have paid to date cover the work that is defective. We are considering whether to pursue this via a legal claim, perhaps on their insurers?
Regarding payment rates, I will put this down as fixed fee but would propose that we speak in order to agree the most appropriate payment structure for your time. As an aside, we are already working very successfully with an IT specialist through PPH.
