Description
Experience Level: Intermediate
General information for the business: Apparel Decorating
Kind of consulting: Legal
Description of consulting work: I'm renegotiating terms with my employer for a new wage and for a commission/residual on all jobs that I handle.
Perhaps "commission" and "residual" are not the best terms—please allow me to explain.
Initially hired as a graphic artist, my responsibilities from day one entailed buying and setting up a screen-print shop, something that I am uniquely qualified to do, but wasn't in my job description. Now that the probationary employment period is over, the business owner is refusing to pay me more, contrary to what we discussed on the day of the interview. I've offered to work at the same wage with no raise, provided I get a percentage of the gross receipt of every screen-print job that comes through the door. He's willing to work with the percentage, but I want it in writing and I want it easy for him to look at and sign.
There are a few gray areas though that I want made black and white.
Embroidery is the owner's primary business, and sometimes a job comes through the door that requires screen-printing AND embroidery on the same article of clothing. I need to spell out how we figure my percentage when this happens.
Finally, the contract needs to state that I will receive a higher percentage of the gross receipt if I bring in the business myself.
Extra notes: This is what I found online, and begins to get at what I'm after:
4. Commission
The Employer shall pay the Employee a commission of 5% of the selling price, exclusive of any sales taxes of each order or part of each order of Product(s) duly remitted by the Agent in accordance with this agreement which is paid for in full, inclusive of any sales taxes and which is not subsequently returned for a refund.

Hi James
Usually an employer provides the contract, not the employee. Have they agreed that you can provide the draft?
