Hello,
We run a nanny agency and we have standard contract that we issue families with when they employ there nanny. However we have had a request from a nanny to include some details to protect her. These details are normally covered under nanny insurance however she would like to see them written in to a contract. We are not sure of the implications of adding the details in and would like advice.
The details are in the nannies words
-liability in case of accidents, injury, death, etc
I know my employer's public liability insurance protects me from third parties, but who protects me from my employer? For example, let's say the child runs out onto the street, I manage to grab them just as a car hits them and the child ends up with a broken arm. My employer's insurance will cover any claims from the driver of the car, but would my employer be able to sue me because the child got injured? I know it's a pretty wild example, I'm just trying to make it clear what I mean.
-if I accidentally damage something in the household, am I liable?
For example, I'm playing hide and seek with the child and we accidentally knock over an expensive vase, who pays to replace it? Am I already covered or can I add a paragraph to say I won't be liable for accidental damages?

Say I am out with the children and have an accident myself, breaking my leg in a fall, I would like this to be covered in my contract as I wouldn't be able to work for a while with an injury but as the accident happened at work, I'd want my employer to pay my full wages during my healing period. The same goes for when the child is severely ill but I'm still asked to work and then contract the same illness, from the child, and am unable to work for a few days. As the child had a contagious illness and I was made to work, I'd want the sick days to be fully paid. I have no problem taking the risk of contagion if the parents really cannot take time off work, I just don't think I should then lose out on my wages as a result.
