Hi,

I require a robust legal based response letter to the owners of a retirement care home where my mother resides - along with 60 or so other elderly tenants - they did not clear with salt or grit the large snowfalls over the period from 20th dec to 6th January blaming national shortgage of grit and salt nationally.

Not inclined to believe this - they should have been prepared prior to winter in the North of Scotland! I wrote to them complaiining that contactors should have been on site clearing the pathways etc but no - their letter states that tenants could have used the bins of salt provided! Most tenants have great difficulty in any movement - never mind clearing snow!! I fell in the snow but again they have ignored this.

They can't be allowed to ignore this problem and blame national salt shortages for their shortcomings. Have letters if required - can fax over.

Private companies did have difficulties in sourcing salt this winter.

It will come down to Duty of Care as the landlord and what is written into the contract. What alternative steps did the owners take?

What is the reason for your letter? Is it just precautionary to cover a future similar event?

Did you sustain an injury? If so what is your loss?

Whilst the Owners have a duty of care they do not necessarily have to exercise that duty, but it does depend on the circumstances and is not just a matter of possible contractural duty.

Morning S & Leigh - can't respond direct. Appreciate your comments re duty of care - however i felt that they did not make any efforts whatsoever to clear the snow from pathways. Wanted to respond but would appear perhaps from your comments that perhaps not worthwhile.
