We need terms and conditions drafting for our business. We supply a product via both dealers/third party installers as well direct to consumers. The product is custom made and then installed in a consumers home. The terms need to cover both trade sales as well as direct consumers sales. We need a standard set of terms adapting to our business needs.

M. on 01/09/2010 19:16 pmIn your case you need to make a strict agreement suiting your business needs, the agreement should be skillfully drafted keeping in view the liability and responsibility of the parties. I understand loopholes embedded in a template and immense financial loss it can result into. Lot will depend upon the product as well, accordingly we need to check the laws of your jurisdiction. I would like to know the territory which you are in.
Here are some practical tips on staying safe
- Never pay any money to Clients and or provide sensitive details like your Bank information, Credit Card or Passwords
- Never accept a Job if you have been directed away from PeoplePerHour to another website
- Be cautious when providing your personal contact details (email, telephone number, instant message ID etc) before your Bid is accepted
- If you have been asked to send samples, put a watermark on them or send low resolution examples to avoid being exposed and not getting paid
- Don’t start work before your Bid is accepted and your Escrow deposit is made
- Keep your Escrow account topped up and ensure that you use the Private Message Board to track all pertinent details about the Job e.g. timelines, deliverables etc
- Before you supply final works to Clients, ensure you have adequate funds in Escrow
