My company was having problems in late 2008, by early 2009 we had £250.000.00 of bad debt (our customers going bust). I asked my accountant for advice and he advised me to talk to a liquidator.
The liquidator asked me to confirm that I did not have a personal guarantee (PG) with Lombard’s whom I had borrowed from for new machinery in sept 2008. It was confirmed over the phone that there was NO PG , I asked for all paperwork regarding the loan to be faxed over to me and again NO PG was there. On this information the liquidator advised me that I should put the company into administration.
I informed Lombard’s that the company was in administration and informed them that the machinery was dismantled and that as I had no PG it was there’s to do with as they see fit. The machinery was placed outside and covered, nothing was herd from Lombard’s, again calls where made to Lombard’s that the machinery was outside waiting for them to take away, again nothing was heard from them until my landlord made it clear that the machinery must be moved and if it was not then he would arrange for it to be scraped, I informed Lombard’s of this and they arranged for removal of the machinery for them to sell on.
On 12/4/2010 over a year after informing them that the company was going into liquidation I revised a letter from Lombard in the form of a payment demand. I went to see a solicitor who wrote to Lombard informing them that I had received misrepresentation from them. Nothing was heard from them until 22/9/2010, this was in the form of a credit note of £3480.85 plus vat in regards to them selling the machinery, my solicitor wrote to Lombard’s asking them to confirm that the machinery was now sold.
The next letter I received was from Lombard’s solicitors letting us know that they would be acting for Lombard’s and also a statement showing payments for the machinery. My solicitor wrote to Lombard’s solicitor asking for documentary evidence to demonstrate that the machinery was sold at a fair market rate.
Again nothing was heard from Lombard until 25th of aug 2011 just over a year from our last correspondence. This time a copy of a PG has been enclosed.
A claim form was sent to me from Leeds county court. I have filled this out and sent it out. I have had a meeting with the district judge at Basildon since then and a trial date has been fixed late 2012.
I now need someone to take up my case
