Title:Legal advice on contract
Location:Anywhere
Job Description
My client has drawn up a 3-page contract for me. I have reservations about the clarity of the English and a couple of the terms. I want to present the client, with which I have a very good relationship, with my own version. I need a lawyer to advise and help me to a make a few changes. The client is an international association registered in Ireland and I am normally based in the UK. One issue is that the client's volunteer Treasurer is in Malta, the contract was drawn up there and she is proposing Malta as the place of jurisdiction in disputes, which does not seem ideal for either Party. The other issues are to do with understanding what I am signing.

Clarification Board
J. B. on 21/07/2010 17:42Dear Jan
Thanks for your interest. I'd be happy to help, but in order to make a bid I'd like to get a little more information about the contract involved. Would it be possible to see the document, or could you perhaps give some details about the content?
On the basis of what you have posted, I agree that Malta seems an odd choice of jurisdiction and would advise you to press for UK jurisdiction if possible.
Best regards
Juliette

J. C. on 22/07/2010 10:42Dear Juliette,
Apparently I can only email you the contract privately if you bid. You can bid and then cancel the bid so perhaps you could put in a nominal amount? Otherwise the contract will go on the clarification board where everyone can see it! thanks jan
Here are some practical tips on staying safe
- Never pay any money to Clients and or provide sensitive details like your Bank information, Credit Card or Passwords
- Never accept a Job if you have been directed away from PeoplePerHour to another website
- Be cautious when providing your personal contact details (email, telephone number, instant message ID etc) before your Bid is accepted
- If you have been asked to send samples, put a watermark on them or send low resolution examples to avoid being exposed and not getting paid
- Don’t start work before your Bid is accepted and your Escrow deposit is made
- Keep your Escrow account topped up and ensure that you use the Private Message Board to track all pertinent details about the Job e.g. timelines, deliverables etc
- Before you supply final works to Clients, ensure you have adequate funds in Escrow
Remember: if something looks too good to be true, it probably is!
