REVISON DESCRIPTION

I have a requirement for the following contract for a new addition to our team. We currently employ a few people on PAYE but are seeking help on drawing up a contract to enable a self employed person to provide testing work on our Companies behalf. The contact needs to take into consideration the following:

1: The person is self employed consultant
2: To provide services under our scheme of accreditation the tester needs to have undergone our training, work to your our test procedures and be covered under our legal umbrella.

The attached Word Document expands the proposed remuneration package.

Another key factor, if possible, is that although work will not be guaranteed, any work we provide from long term contracts will take priority over any other work.

Please advice the best way to achieve the points above?

The self employed person is referred to as DB.

Our proposal would then be to make remuneration to DB at three different rates:

1. Business DB brings in himself will be processed through our established procedure, and there will be a 60/40% split of income - 60% to Dave Ball/ 40% to our company. Rates charged are based at around £40 per hour (see NOTE 1) and will include all travel time and mileage.

2. For small or one-off jobs that Site Sound wins the fees will be split 50/50 between ourselves and DB. Travel expenses will be remunerated on a mileage basis at 42 pence per mile (see NOTE 2).

3. For larger contracts e.g. where we are likely to get more than twenty hours work, or for contracts that may be spread over many months, I propose a flat hourly rate of £35 per hour. Travel expenses will be remunerated on a mileage basis at 42 pence per mile (see NOTE 2).

Our company will cover the cost of DB equipment being calibrated. This amount will be recovered as deductions from the fees paid to him over an agreed period of time.

NOTE 1: Industry rates are currently in a state of flux and have been falling. We will therefore have to monitor this closely and will have to be flexible to adapt to market forces. To ensure we remain competitive the target hourly rate will be regularly reviewed.

NOTE 2: The first two hours of the daily total travel time is regarded as journey to/from work and is therefore unpaid; travel time in excess of two hours daily will be paid at a rate of £25 per hour. All travel expenses will be remunerated on a mileage basis at 42 pence per mile.


NOTE 3 : We are looking into the possibility of taking the current responsibility of the report-writing process away from the engineer. If this decision is made, we would need to be able to renegotiate rates and income splits accordingly.

Dear Mike

I would like to assist you with this project but it is restricted to freelancers from the United States is this correct?

And is the reason for this restricton due to the fact that the agreement is to be governed by US law? If so which US state law?

Any reference to the US is an error - it should be the UK.

Mike,

Not sure where my previous clarification message has gone - seems to have been deleted for some reason.

The bidding restriction on this job is still only for freelancers based in the US.
