Job Description

I am planning to rent a tiny office space in West London and I am seeking someone to provide legal advice during my negotiations with a landlord.

I've already made an offer and the main terms were agreed with the landlord (lease term: 3 years, 2 months deposit , break clause - after 2 years).

Basically I will probably need to review the lease agreement provided by the landlord or draft it together with the landlord's solicitor with the provided the Head of terms (property agent wasn't clear about this)

Also I want to make some improvements to the property at my expense but don't want the landlord to increase the price after 3 years due to these improvements made by me.

I'm quite literate in legal terms and I'm not willing to pay huge money to someone who will tell me common sense and explain me what break clause means.

Hi, before I submit a bid I need to know the following;

1. Is this office space in serviced office or a separate part of whole property.

2. How long is any draft terms you have.

3. Is security of lease (tenure) excluded.

1. it's a ground floor office. Upstairs is a residential flat with a separate entrance. It's agreed I only pay internal repairs.

2. the terms are as described above

Do you have the draft lease, if so please attach as the length and content makes a difference to rate charged.

As security is excluded, there is no obligation in law for a new lease at the end of the term usually compensation can be excluded for leases upto 5 years in length so I don't understand why the risk of rent increase could be something you could guard against, unless you have side or comfort letter to that effect.

I've just recently received the lease draft from landlord's solicitors. I'm afraid PPH doesn't allow to attach docs. The "underlease" is 29 pages, 7200 words long. The landlord is himself long leaseholder, so there is also a "headlease" attached (26 pages). There are some references in the lease to the clauses of headlease where the landlord must pay all outgoings etc and in the lease, as I understand, the landlord wants me, the tenant, pay all of these.

The landlord also wants me to pay for insurance against loss of rent for 3 years (as the term of lease).

The lease will be between my newly established company with no history of profit, no references, no personal guarantees etc. However bearing in mind that my offer for the premises is somewhat above the market price and outgoings and insurance was not discussed or agreed in the head of terms, I'm not really keen on to pay for them. I would like to have an advice on this and negotiate this with the landlord / his solicitors. As I can see there is no big demand in this area and the landlord is keen on to sign the lease. I'm also interested in the premises (mostly because I live very close to them).

The rent is 16k per annum. The property is a former garage with painted concrete floor and painted brick walls with a WC & kitchenette.

It was agreed that the landlord will provide 1 month rent free if I install glazed facade instead of garage doors. Apparently I will need to make more essential improvements like installing heating radiators (there is none now). I guess the landlord should also pay for this.

I have marked some clauses in the lease and would want some explanation on them and negotiate the above mentioned with the landlord's solicitor with your help or as my representative.
